Proof of Claim (POC) Process

Amwest has completed preliminary determination for 91 percent of POCs received. Claimants filing an Amwest policy or bond loss comprise the largest priority of distribution class (Class Code 3). The Liquidator currently anticipate that members of this Class Code 3 will receive a pro-rata distribution of their allowed claimed amount.

Once all POCs have been reviewed and determinations completed, a Report of Claims and Recommendations will be filed with the Liquidation Court for approval. All POCs must have their claimed amount and class of claim determination completed and allowed by the Liquidation Court prior to any distribution.

The Liquidator has received 876 objections to the POC determinations. The objections that cannot be resolved will be forwarded to the Liquidation Court appointed Referee in Nebraska.
